THE WEST END FLATS – TERMS OF SERVICE
Effective Date: 01/01/2025


1. AGREEMENT TO TERMS

By booking, checking in, or staying at The West End Flats (“Hotel,” “we,” “us,” or “our”), you (“Guest”) acknowledge and agree to these Terms of Service (“Terms”). These Terms constitute a legally binding agreement, and failure to comply may result in cancellation of reservations, eviction without refund, and/or legal action.


2. RESERVATIONS, CANCELLATIONS & MODIFICATIONS

2.1 Reservation Requirements

All reservations require a valid credit card and government-issued identification.

The Hotel reserves the right to pre-authorize credit cards before arrival.

Guests must be at least 21 years of age to check in.

2.2 Cancellation & No-Show Policy

Reservations canceled within 72 hours of check-in are non-refundable.

No-shows will be charged for the full reservation amount, including applicable taxes and fees.

Refunds, if applicable, are at the sole discretion of the Hotel and will be processed within 30 business days.

2.3 Modifications & Early Departures

Any modifications are subject to availability and may incur additional charges.

Early departures are non-refundable.


3. CHECK-IN, CHECK-OUT & HOTEL ACCESS

3.1 Check-In & Identification

Standard check-in time is 3:00 PM; early check-in is subject to availability and additional fees.

A valid photo ID and a credit card matching the reservation name are required at check-in.

3.2 Security Deposit

A refundable security deposit of $200.00 (or a higher amount at management’s discretion) is required upon check-in for incidentals and damages.

3.3 Check-Out

Check-out time is 11:00 AM. Late check-out may incur a full-day charge.

3.4 Right to Refuse Service

The Hotel reserves the right to refuse accommodation or service to any individual at its sole discretion, without liability or explanation.


4. HOTEL RULES & REGULATIONS

4.1 Conduct & Behavior

Guests must comply with all hotel policies, local laws, and management directives.

No excessive noise, disruptive behavior, or parties are permitted. Violations will result in immediate eviction without refund.

4.2 Room Occupancy Limits

Maximum occupancy per room is strictly enforced. Unauthorized occupants will be charged at a rate of $100 per person, per night.

4.3 Property Damage & Liability

Guests are fully responsible for any damages caused to the room, furnishings, or hotel property. The Hotel reserves the right to charge the full cost of damages, including loss of revenue due to unusable rooms.

4.4 Smoking & Drug Use

Smoking (including vaping, marijuana, and e-cigarettes) is strictly prohibited. A penalty of $500.00 will be charged for violations.

The Hotel has a zero-tolerance drug policy; violations will result in eviction and police notification.

4.5 Pets & Service Animals

ADA-compliant service animals are permitted. Emotional support animals are not recognized under this policy.

Pets are allowed for a fee of $100

A non-refundable cleaning fee of $250 will be charged for unauthorized pets.


5. LIMITATION OF LIABILITY

The Hotel is not responsible for lost, stolen, or damaged personal belongings, including valuables left in rooms or vehicles.

Guests agree to indemnify and hold harmless the Hotel, its employees, and affiliates from any claims, damages, or expenses arising from their stay.

The Hotel is not liable for interruptions in utilities, HVAC, Wi-Fi, or other services. Refunds or discounts will not be provided for such inconveniences.


6. FORCE MAJEURE

The Hotel is not liable for failure to provide services due to circumstances beyond its control, including but not limited to acts of God, natural disasters, pandemics, power failures, or government regulations.


7. DISPUTE RESOLUTION & ARBITRATION

7.1 Mandatory Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, your stay, or services provided by The West End Flats shall be resolved exclusively through binding arbitration in the Commonwealth of Virginia.

Arbitration shall be conducted in accordance with the Virginia Uniform Arbitration Act and administered by the American Arbitration Association (AAA).

By agreeing to these Terms, you waive your right to a trial by jury or participation in a class action lawsuit.

7.2 Governing Law

These Terms shall be governed and construed under the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.


8. AMENDMENTS & TERMINATION

The Hotel reserves the right to update or amend these Terms at any time without prior notice.

Continued use of the Hotel’s services constitutes acceptance of any modifications.
